Public Procurement

We provide legal assistance in public procurement procedures.  We support our clients regardless of the scale of the project. We undertake both the handling of procurements whose value reaches a few hundred thousand and a few billion zlotys.

We provide our clients with professional legal advice on public procurement proceedings. We provide services to both contracting entities and contractors.

While advising the contracting entities, we provide assistance in the selection of the mode of proceedings, adapted to the specific needs and conditions of the contract. We attach particular importance to optimizing and fully securing the proceedings from a formal and legal perspective. The advice we provide is comprehensive. It lasts from the beginning until the completion of the procedure and conclusion of the procurement contract.

We provide legal support to contractors at both the pre- and post-bid stages. Contractors can also count on our assistance in the process of contract execution and settlement.

Members of our team are experienced in conducting audits. They have repeatedly conducted training courses on public procurement law, also for practitioners. Our lawyers also have experience working as in-house lawyers in the procurement departments of various entities. We know that each proceeding is different and requires an individual approach. Therefore, each of our clients can count on an independent project team, composed of specialists selected according to the needs and specifics of the procurement.

Contracting entities are provided with:

• assistance in the selection of the procedure mode;
• preparation of full procurement documentation (also in the standard of FIDIC contracts);
• support in drafting documents, including correspondence with contractors;
• representation in appeal proceedings before the National Appeals Chamber and public procurement courts;
• preparation of internally binding acts, regulations and model documentation for proceedings.

Contractors are offered:

• development of a strategy for participation in the proceedings;
• preparation of all documentation required in the proceedings;
• preparation of bids;
• verification of the content of the terms of reference;
• submission of requests for clarification of the content of the terms of reference;
• preparation of letters and clarifications submitted at the request of contracting entities;
• representation in appeal proceedings before the National Appeals Chamber and public procurement courts;
• counseling during the execution of contracts – assistance in the selection of subcontractors, representation in contacts with contracting entities, opinion on annexes to contracts.

We also prepare legal opinions on issues in or related to public procurement law. 

 Our achievements:

• We have represented clients before the National Appeals Chamber in cases in which the value of public contracts awarded exceeded PLN 2 billion;
• We have obtained favorable rulings for our clients by the National Appeals Chamber by, among other things, changing the content of the terms of reference, annulling the selection of the most advantageous offer or annulling the rejection of the offer;
• We conducted audits to diagnose irregularities in the awarding of public contracts. We provided legal advice to eliminate them;
• We provided assistance to foreign clients in the preparation of properly drafted documents, translations, references, etc., necessary to successfully submit a bid and obtain a contract.
